Good Day Photo Contest
Official Rules

NO PURCHASE NECESSARY.  A purchase does not increase your chances of winning.

PRIZES.    25 - 40 photos will be chosen from among all photos submitted.  The participant of each winning photo will receive two complimentary lift tickets, valid daily, non-holiday good at Northstar-at-Tahoe Resort.  Estimated retail value of the Prize is $148 (subject to change based on 2008/09 pricing).  Each Winner is responsible for all federal, state and local taxes associated with acceptance and use of the respective prize.   No substitution or cash redemptions of Prizes by Winners.  If any Winner is a minor (under the age of 18 years of age), then that Winner's Prize shall be awarded to and must be accepted by that Winner's parent or legal guardian. 


HOW TO ENTER. To enter, submit your best low resolution images (250 kb or lower) to us via email to agooddayphotos@northstarattahoe.com by May 3, 2008.  Please send no more than five (5) photos at a time.  Large resolution (300 dpi) will be required of winners.  Please include your name, email address and phone number with your photos so we can contact the Winners.  To request an entry form by mail, write your name and address on a 3” x 5” index card and mail to A Good Day Photo Contest, 11025 Pioneer Trail, Suite 100, Truckee, CA 96161.  All entries must be received by May 3, 2008. Sponsor is not responsible for entries that are late, lost, incomplete, incorrect, illegible, damaged, misdirected or misrouted.  All Contest entries become the property of Sponsor.


ELIGIBILITY .  This A Good Day Photo Contest (“Contest”) is open to individual persons (each, an “Entrant”) who are legal residents of the 50 United States, including the District of Columbia.  All federal, state, and local laws and regulations apply.  Void where prohibited or restricted.  Limit one entry per person/household/e-mail address.  By entering this Contest, participants agree to be bound by these Official Rules and the decisions of the Sponsor and/or its agents.  Odds of winning Prize depend on the number of eligible entries received.  Click here to see our Privacy Policy.  To request a copy of our Privacy Policy, write to Northstar-at-Tahoe Resort Contest Privacy Policy, 11025 Pioneer Trail, Suite 100, Truckee, CA 96161.


OPT OUT.  By entering this Contest, Entrant agrees that, unless Entrant otherwise opts out by writing to Northstar-at-Tahoe Resort Contest Opt Out, 11025 Pioneer Trail, Suite 100, Truckee, California 96161, requesting Entrant’s name be removed from future mailings, Sponsor may use Entrant’s physical and/or e-mail address to contact Entrant regarding Sponsor’s offers and/or promotions that Sponsor believes may be of interest to Entrant. 


DRAWING AND ODDS OF WINNING.   Sponsor will select 25 - 40 photos, from all photos properly received (abiding by terms and use), based on quality and creativity.  Winners will be determined by a combination of Northstar-at-Tahoe marketing team and advertising agency, Eleven.  The odds of winning will be determined by the number of eligible entries received. Any Entrant who is selected from the Contest shall be deemed a potential winner, and such Entrant and his or her entry shall be subject to verification and the requirements of these Official Rules.  No Entrant shall be the Winner(s) unless and until his or her entry and any other submissions required by these Official Rules (including, without limitation, affidavits of eligibility publicity releases, liability waivers and/or IRS Forms W-9s) are validated. 

JUDGING AND ODDS OF WINNING.   Sponsor will select 25 - 40 photos from all photo entries properly received (abiding by terms and use).  Judging is based on the following criteria: quality and creativity of the photos, with equal weight given to each criterion. Prize Winners will be notified on June 30, 2008.  In addition, photos submitted may not have been entered in any other contest or won any other award; may not have been published previously; and may not be subject to any rights of any other parties.  Photos may not be offensive, as determined by the Northstar-at-Tahoe marketing judges in their sole discretion.  Entrants not complying with these requirements will be subject to disqualification.  Entrant unconditionally assigns and transfers to Sponsor all rights, title and interest which it now has or may in the future have to the video.  Sponsor shall have the right to use, assign, edit, modify, or dispose of the video in any manner it sees fit without the approval of Entrant. 

The odds of winning each Prize will be determined by the number of eligible entries received. Any Entrant who is selected from the Contest shall be deemed a potential winner, and such Entrant and his or her entry shall be subject to verification and the requirements of these Official Rules.  No Entrant shall be a Prize Winner unless and until his or her entry and any other submissions required by these Official Rules (including, without limitation, affidavits of eligibility publicity releases, liability waivers and/or IRS Forms W-9s) are validated.


PRIZE WINNER NOTIFICATION AND REDEMPTION.   Sponsor will notify Prize Winners by e-mail Prize Winner information will also be posted on the Sponsor's web site by June 30, 2008   Sponsor will require Winners to send large resolution (300 dpi or higher) of the photos.  Sponsor may require Prize Winners to execute an affidavit of eligibility, publicity release (except where prohibited), liability waiver, IRS Form W-9, affidavit of non-transferability and/or exculpatory agreements, prior to the delivery of the Prize.  If the Winner(s) does not respond to the Prize notification within 72 hours or is found to be ineligible, Sponsor will consider the Winner(s) to have forfeited the Prize(s), and Sponsor will not select any alternate winners.  All unclaimed Prizes will not be awarded.  Sponsor reserves the right to disqualify any Entrant for any reason, including, without limitation, if Entrant has not complied with these Official Rules or has interfered, in Sponsor’s sole opinion, with the proper conduct of this Contest.  Payment of any/all taxes is the sole responsibility of the Prize Winner.  Each Prize Winner may be required to sign and return by mail within ten (10) days of receipt the Affidavit of Eligibility and Release and substitute W-9 form (including social security number).  If the Prize Winner fails to return these forms within the time required the Prize will be forfeited.  Prior to receiving a Prize, each Winner will be required to comply with rules and regulations, specifically including but not limited to execution by Prize Winner (or by Prize Winner's parent or legal guardian if Prize Winner is a minor) of a liability waiver and release prior to receiving the Prize.


LIABILITY .  Prize acceptance constitutes permission (except where prohibited) to use Winner’s name and likeness for publicity purposes without compensation therefor.  Sponsor and its promotional and advertising agencies, and all respective officers, directors, employees, representatives and agents of each, shall have no liability and shall be held harmless by Winner(s) for any damage, loss of liability to persons or property, due in whole or in part, directly or indirectly by reason of the acceptance, possession, use or misuse of Prize or participation in this Contests.  Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend part or all of this Contest should unauthorized human intervention or other cause beyond the control of Sponsor corrupt or impair the administration, security, fairness or proper play of the Contest.  Sponsor and its promotion and advertising agencies, and all respective officers, directors, employees, representatives and agents of each, are not responsible for fraud or by any technical or human error which may occur in the processing of submissions which may limit an Entrant’s ability to participate in the Contests.  Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor reasonably believes to have tampered with the entry process or with the operation of the Contest, or who is found to be acting in violation of these Official Rules.  This Contest is intended and limited for play in the United States and shall only be construed and evaluated according to United States law.


DISPUTE RESOLUTION; LIMITATION OF LIABILITY.  Each Entrant agrees to release, defend, indemnify and hold harmless Trimont Land Company, its parent companies and/or affiliates, and those working on their behalf, and each of their respective officers, directors, representatives, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way relate to Entrant’s participation in the Contest or the awarding, acceptance, use or misuse of a Prize.  Any and all disputes, claims, and causes of action arising out of or in connection with this Contest shall be resolved individually, without resort to any form of class action.  This Contest shall be governed by and construed in accordance with the laws of the State of California, regardless of principles of conflicts of laws that may require the application of the laws of another jurisdiction.  Any action or litigation concerning this Contest shall be in the state court in and for Placer County, California.  Each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts.  Each Entrant agrees to service of process by mail or other method acceptable under the laws of the state of California.  ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION.  ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEYS’ FEES, INCIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.


GENERAL CONDITIONS.  This Contest is subject to all applicable Federal, State and local laws and regulations.  By entering this Contest, each Entrant agrees to be bound by these Official Rules and the decisions of Sponsor, and to accept delivery of a Prize based upon availability.  In addition, each Entrant represents and warrants that all information contained in his or her entry is true and accurate.  Sponsor is not responsible for any printing or typographical errors in these Official Rules.  Sponsor reserves the right to cancel this Contest at any time and substitute another promotion in its place.  Sponsor is not responsible for injury or damage to Entrants’ or to any other person's computer related to or resulting from participating in this Contest. In the event this Contest is compromised for any reason fraud, unauthorized intervention or other causes beyond the control of Sponsor) which, in the sole opinion of Sponsor, corrupts or impairs the administration, security, fairness or proper play of this Contest, Sponsor reserves the right in its sole discretion to suspend, modify or terminate this Contest.  This Contest is void where prohibited.
