Fair Trademark Use Guidelines

 

"Northstar" and "Northstar at Tahoe" are service marks owned by Trimont Land Company and may only be used to properly refer to the Northstar™ resort.  The following are general guidelines for the proper use of the Northstar™ mark and the Northstar at Tahoe® mark.  These guidelines are based on the legal standards set forth in practice under U.S. trademark law and the trademark laws of most foreign countries.  Any use of the trademarks that is inconsistent with these guidelines, or other unauthorized use of the Northstar™ mark or the Northstar at Tahoe® mark that is confusingly similar to the marks, may be unlawful.  These trademarks are valuable assets to us and we will protect them.  If you have any questions regarding these guidelines, please contact us.

 

Permissible Use:

You may only make nominative fair use of the Northstar™ mark or Northstar at Tahoe® mark to make true, factual statements about the resort or any products bearing its mark.

When making the nominative fair use of the marks, you should adhere to the following:

You MAY reference Northstar™ resort in a complete sentence, as it would be used in the ordinary course of use of the English language.

 

DO use Northstar™ as an adjective followed by a generic term, not as a noun. 

For example, you may properly say, "we represent properties located within the Northstar™ resort or "we live at the Northstar™ resort." You may not say, "We represent properties at Northstar™."

DO use the appropriate symbol.  Currently, a ™ should be used when referring to Northstar™ resort, and a ® should be used when referring to Northstar at Tahoe® resort.

DO properly disclose at the bottom of any page, either printed or on the web, in which you use Northstar™ or Northstar at Tahoe®, that such trademarks are owned by Trimont Land Company and clarify that you are not affiliated with the resort or Trimont Land Company in any way. 

The following language is appropriate:

"NORTHSTAR™ and NORTHSTAR AT TAHOE® are trademarks owned by Trimont Land Company, the owner and operator of the Northstar at Tahoe® resort.  This [company/publication/ product/website] is in no way associated with Northstar™ resort or Trimont Land Company."

You MAY create a link directly to the home page of the official Northstar™ resort website, www.northstarattahoe.com, and label it as the official site.  For example, you may state, "For more information about the slopes, trails and lifts at Northstar™ resort, visit the official Northstar™ resort website."

 

Prohibited Use:

You MAY NOT use Northstar™ or Northstar at Tahoe® alone as a title, noun, or a geographic indicator.

DO NOT use Northstar™ or Northstar at Tahoe® as part of your own business name, as part of a brand name for your product, as an internet domain name, in whole or in part, or as a keyword search term for your web address.

DO NOT use Northstar™ or Northstar at Tahoe® as part of a tagline or advertising blurb.

DO NOT use Northstar™ or Northstar at Tahoe® in any way that would create confusion regarding the ownership of the marks.

DO NOT use language or other materials from the official Northstar at Tahoe® resort website on your own website.

DO NOT frame the content of the official Northstar at Tahoe® resort website on your website.
